Can I fight a denied workers’ compensation claim?
Clients often come to us after their claim has been “controverted” or denied, asking how that can be changed. The good news is, this can be fought. On the downside, it may take a little bit before it’s reversed. Injured workers who find themselves being denied workers’ compensation benefits can easily get behind on rent or mortgage, car payments, and other bills. They also may not be receiving medical treatment which can truly hurt your recovery time. It is possible to fight a denial, it just takes some time to do so. In the meantime, the injured worker may decide to settle the claim. Once benefits are denied a motion or hearing request will need to be filed so that a Judge can review the matter. In order not to delay recovery, once a denial happens, you can seek medical treatment using your personal insurance, if you have a plan.
If your claim has been denied you will need to take immediate action to correct the problem. An attorney will likely need to get involved at this stage so that you can concentrate on recovery and not fighting with the insurance company.
