The State Board of Workers’ Compensation requires notice of temporary partial disability conversion

Effective January 1, 2014, Board Rule 104 requires that Form WC-104 be filed with the Board at the same time it is served on the employee and counsel for the employee (within 60 days of the release of the employee to return to work with restrictions by the authorized treating physician). Many times, the Employer/Insurer will claim that notice was given but it was “lost in the mail.”  This Board Rule attempts to eliminate any notice issues that may arise when the Employer/Insurer attempts to convert temporary total disability to temporary partial disability benefits.  This conversion has significant impact on the value of the claim and the ability of the injured worker to financially survive on a weekly basis.
